1. General Terms & Conditions of use of our website

This page sets out the Terms and Conditions (the “T&Cs”) of use of our website, whether you are accessing it as a guest or a registered user.

This site is owned and operated by Foodies Box Ltd, a limited liability company registered in England and Wales under the number 8226072. By using our site you indicate that you accept these terms of use and you agree to abide by them.

Please be aware that we may update these T&Cs at any time. Any such changes will take effect when posted on the website. It is therefore advised that you review the T&Cs on each occasion you use our website. Your continued use of the website shall signify your acceptance to be bound by the latest T&Cs. If you do not agree to be bound by these T&Cs you should not use nor access this website.

Please note that we process information about you in accordance with our Privacy Policy.  By using our site, you consent to processing your information and you warrant that all data provided by you is accurate.

2. Registration

Access to certain areas of our website will require registration and subsequent access to the website will be subject to an approved login name and password. The information that you provide when registering to our website must be accurate and complete.

Please note that you are responsible for the confidentiality and maintenance of your personal account information and password.

If you have any reason to suspect that your password has become known by someone else, has been or is likely to be used without your authorization, you should contact us immediately. Foodies Box Ltd shall not be liable to any person for any loss or damage as a failure by you to protect your password or account details.

We have the right to disable your account if in our opinion you have failed to comply with our terms of use.

Access to our site is permitted on a temporary basis and we reserve the right to withdraw or amend the service we provide on our site without notice.

3. Orders

You are entering into a contract with Foodies Box Ltd when you place an order on our website.

By placing an order through our site, you promise that:

(a)          you are legally capable of entering into binding contracts; and

(b)          you are at least 18 years old.

After placing an order, you will receive an e-mail from us acknowledging that we have received your order.  Please note that this does not mean that your order has been accepted.  Your order constitutes an offer to us to buy a product.  All orders are subject to acceptance by us in accordance with our T&Cs. We will confirm acceptance to you by sending you an e-mail that confirms that the product has been dispatched (“Dispatch Confirmation”).  The contract between us will only be formed when we send you the Dispatch Confirmation.

The Contract will relate only to those products whose dispatch we have confirmed in the Dispatch Confirmation.  We will not be obliged to supply any other products which may have been part of your order until the dispatch of such products has been confirmed in a separate Dispatch Confirmation. You must provide us with your correct e-mail address. We cannot be held liable when an order has been delayed by the fact that you provided us with an incorrect e-mail address.

In certain conditions, we reserve the right to refuse an order, when:

  • the product ordered is out of stock;
  • we cannot obtain the authorization of payment for the goods you have ordered;
  • one or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers;
  • you do not meet the eligibility to order, as set out in the T&Cs.

Also, please note that commentary and other materials posted on our site are not intended to amount to advice on which reliance should be placed.  We therefore disclaim all liability and responsibility arising from any reliance placed on those materials by any visitor to our site, or by anyone who may be informed of any of its contents.

4. Availability

Promotions on are subject to availability and we reserve the right to restrict quantity.

If a product on your order is out of stock, we will inform you by email and will offer you either an alternative product of similar value or a refund on your card.

If the Dispatch email or delivery note says an item should be in your parcel but it is not, please contact our customer care team within 48h of receipt on with your order number and product code/name of the missing item.

If you want an item that is out of stock, just contact us on and we will order it for you.

5. Price & Payment

a) Price

The price of any products will be as quoted on our website at the time we receive your order, except in cases of obvious error. If we discover an error in the price of goods you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. If you / we cancel and you have already paid for the goods, you will receive a full refund.

Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Dispatch Confirmation.

Prices include VAT (where applicable) but exclude delivery costs, which will be added to the total amount due as set out in our Delivery Guide.

b) Payment

We accept payment via most major credit and debit cards through SagePay and PayPal.

After placing your order, and once your card has been authorised, payment will be taken immediately. You will then receive an email confirming that your order has been successful. Goods will be dispatched once full payment has been received.

If your card is not authorised, payment will not be taken and you will be notified immediately on the screen that the payment was unsuccessful. Your order will then be cancelled.

We take security very seriously so, although it can sometimes be a pain, all credit and debit card holders are subject to validation and authorization, to maintain security and prevent fraud.

c) Cancellation policy

We reserve the right to cancel the contract between us if:

We cannot obtain the authorisation of payment for the goods you have ordered;

We have insufficient stock to deliver the goods you have ordered;

We do not deliver to your area;

One or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.

If we do cancel your contract we will notify you by e-mail and, in case the payment had already been processed, will re-credit your account with any sum deducted by us as soon as possible and, in any event, within 30 days of your order.

6. Miscellaneous

Intellectual property rights

We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. All such rights are reserved.

You may print off, and download extracts of any page(s) from our site for your personal reference and you may draw the attention of others to material posted on our site. 

Our status (and that of any identified contributors) as the authors of material on our site must always be acknowledged.

You must not use any part of the materials on our site for commercial purposes without obtaining a licence to do so from us or our licensors.

If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

Viruses, hacking and other offences

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack.

By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any material posted on it, or on any website linked to it.

Linking to our website

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

You must not establish a link from any website that is not owned by you.

Our site must not be framed on any other site, nor may you create a link to any part of our site other than the home page. We reserve the right to withdraw linking permission without notice.

Jurisdiction and applicable law

The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our site (although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country).
